Supervision and compliance play an increasingly important role in our rapidly changing world. We advise and assist clients such as insurance companies, financial institutions, trust companies, telecommunications companies, other service providers, trading companies and manufacturers in their relationships and disputes with regulators such as the Central Bank of Curaçao and St. Maarten, the Bureau of Telecommunications and Post, the Corporate Governance Advisor (Supervising Bureau and Standards for Government Entities Foundation), the Gaming Control Board and the Curaçao government, as the regulator and executor in numerous policy areas such as pricing policy and public tendering. Internationally, more and more often we receive requests for advice related to complying with local laws and regulations from companies doing business in Curacao or that intend to do business here. We also advise the regulators themselves in similar situations.
In line with supervision and compliance, we practice financial and economic criminal law. We advise and provide companies and company directors with practical support in the event of suspected financial or economic offenses, such as: premises searches, criminal (third parties) investigations, financial transactions and legal representation in criminal proceedings. We are also involved in consulting and planning to prevent violations in the area of financial and economic criminal law and the related (hefty) fines and damage to one’s reputation.
